16. Can the retailer (e.g. supermarket) demand a licensing confirmation from their suppliers?

According to § 6 (1), 3 German Packaging Ordinance only packaging which has been licensed may be distributed to private end-users. This concludes a legitimate interest of the distributor to have the licensing participation being confirmed.
According to the Bund/Länder-Arbeitsgemeinschaft Abfall (LAGA) this may be satisfied with a signed confirmation of the producer or pre-distributor.
