9. How is the term „comparable places where packaging arises“ defined in regard to the classification of packaging for „private end-users“ and for „industrial end-users“?
"Comparable places where packaging arises" are not directly defined in the German Packaging Ordinance. They are circumscribed with a list of examples introduced with the word „in particular“. To distinguish between sales packaging for the private end-user and sales packaging for industrial end-users it is therefore reasonable to consider the packaging typically arising at private households as § 6 of the new German Packaging Ordinance includes another classification criteria, the word „typically".
Thus packaging for products such as furniture, windows, building materials and electrical goods is considered as packaging for private end-users besides typical food packaging. In contrast all packaging for commodities and machines which is used outside private households and big, bulky packaging is attributed to packaging for industrial end-users.
