15. Is it possible for a retailer to demand a change to another dual system from his distributor?
As far as the distributor is the first one to place sales packaging for the „private end-user” on the market he underlies the obligations of § 6 of the German Packaging Ordinance and usually participates with one of the nine dual systems currently in place. According to the regulations a change of the licensée (e.g. from the retailer to the bottler) might have been necessary as of 1 January 2009.
The customer (e.g. a supermarket chain) cannot demand from their distributor a change from system “A” to system “B” referring to the Packaging Ordinance.
In case of an expressed demand it is recommended though to contact the customer and find the best possible solution for both sides.
