11. What are the obligations for companies placing sales packaging on the market?
According to § 6 (1) of the German Packaging Ordinance companies placing sales packaging on the market for the first time are obligated to participate in one of the dual systems. Alternatively they can participate in an industrial-specific solution according to § 6 (2) of the German Packaging Ordinance for sales packaging collected at comparable places where packaging arises (not sales packaging of private households).
A combination of the two above mentioned alternatives is possible, with part of sales packaging reported with a dual system and the remaining part reported with an industrial-specific solution.
According to § 6 (1) of the German Packaging Ordinance it is possible to take back and recycle used sales packaging by yourself for sales packaging reported with a dual system. This brings about a claim for refund of the prepaid licensing fees for the sales packaging taken back by yourself.
The possibility of “self-management waste disposal solutions” (until 31 December 2008) is not allowed anymore since 1 Januar 2009.
