22. What consequences are entailed for companies which do not license?
The following consequences – dependent on the claimant, legal process and type of claim – can be expected:
- A fine of up to 50.000 € per claim (government agency)
- Administrative order in the form of a prohibition of trade (government agency)
- Injunction in the form of a prohibition of trade and claim of damages (claim of competitor)
- Retroactive payment of licensing fees (claim of dual system)
