The new Elec\u00adtri\u00adcal and Elec\u00adtro\u00adnic Equip\u00adment Act (Elek\u00adtroG) was published on 27 May 2021 and came into force on 1 Janu\u00adary 2022. Here are the most important chan\u00adges affec\u00adting manu\u00adfac\u00adtu\u00adrer and dis\u00adtri\u00adbu\u00adtor obli\u00adga\u00adti\u00adons: <\/h4>\n

Take-back con\u00adcept (Sec\u00adtion 7 a amen\u00added Elek\u00adtroG):<\/h4>\n
    \n
  • Under the new law, for B2B regis\u00adtra\u00adti\u00adons, manu\u00adfac\u00adtu\u00adr\u00aders (or their aut\u00adho\u00adri\u00adsed repre\u00adsen\u00adta\u00adti\u00adve) have to sub\u00admit a take-back con\u00adcept for the dis\u00adpo\u00adsal of future WEEE.<\/li>\n<\/ul>\n

    Take-back obli\u00adga\u00adti\u00adon (Sec\u00adtion 19 amen\u00added Elek\u00adtroG):<\/h4>\n
      \n
    • Amend\u00adment of the pre\u00advious pro\u00advi\u00adsi\u00adon, under which devia\u00adting agree\u00adments on the future dis\u00adpo\u00adsal of B2B equip\u00adment could be made bet\u00adween the sel\u00adler and the buy\u00ader.<\/li>\n
    • New pro\u00advi\u00adsi\u00adon: The pos\u00adsi\u00adbi\u00adli\u00adty of agre\u00ade\u00ading devia\u00adting pro\u00advi\u00adsi\u00adons is now limi\u00adt\u00aded to future dis\u00adpo\u00adsal cos\u00adts. This means that reasonable return opti\u00adons must be pro\u00advi\u00added. <\/li>\n<\/ul>\n

      Infor\u00adma\u00adti\u00adon obli\u00adga\u00adti\u00adons:<\/h4>\n
        \n
      • Accor\u00adding to Sec\u00adtion 19 (a) amen\u00added Elek\u00adtroG, manu\u00adfac\u00adtu\u00adr\u00aders are obli\u00adged to pro\u00advi\u00adde the fol\u00adlo\u00adwing infor\u00adma\u00adti\u00adon con\u00adcer\u00adning B2B equip\u00adment:\n
          \n
        • opti\u00adons for retur\u00adning and dis\u00adpo\u00adsing of was\u00adte equip\u00adment offe\u00adred by them;<\/li>\n
        • end-user respon\u00adsi\u00adbi\u00adli\u00adty for dele\u00adting per\u00adso\u00adnal data from the was\u00adte equip\u00adment to be dis\u00adpo\u00adsed of; and<\/li>\n
        • the mea\u00adning of the sym\u00adbol accor\u00adding to Annex 3 (\u201ccrossed-out whee\u00adled bin\u201d)<\/li>\n<\/ul>\n<\/li>\n
        • In addi\u00adti\u00adon, B2B equip\u00adment must also be mark\u00aded with the \u201ccrossed-out whee\u00adled bin\u201d sym\u00adbol. This appli\u00ades to all devices first pla\u00adced on the mar\u00adket after 1 Janu\u00adary 2023. <\/li>\n
        • Accor\u00adding to the new Sec\u00adtion 4 para. 4 amen\u00added Elek\u00adtroG, manu\u00adfac\u00adtu\u00adr\u00aders are obli\u00adged to enc\u00adlo\u00adse infor\u00adma\u00adti\u00adon with elec\u00adtri\u00adcal and elec\u00adtro\u00adnic equip\u00adment con\u00adtai\u00adning a bat\u00adtery or an accu\u00admu\u00adla\u00adtor, informing end-users about the type and the che\u00admi\u00adcal sys\u00adtem of the bat\u00adtery or accu\u00admu\u00adla\u00adtor, and about its safe rem\u00adoval. The end-user or inde\u00adpen\u00addent qua\u00adli\u00adfied per\u00adson\u00adnel should be able to remo\u00adve the bat\u00adtery or accu\u00admu\u00adla\u00adtor easi\u00adly and non-des\u00adtruc\u00adtively from was\u00adte equip\u00adment when it is retur\u00adned. <\/li>\n
        • Fur\u00adther chan\u00adges for manu\u00adfac\u00adtu\u00adr\u00aders con\u00adcern their infor\u00adma\u00adti\u00adon obli\u00adga\u00adti\u00adons towards cus\u00adto\u00admers accor\u00adding to Sec\u00adtion 18 para. 4 amen\u00added Elek\u00adtroG (brea\u00adches are now con\u00adside\u00adred regu\u00adla\u00adto\u00adry offen\u00adces) and their report\u00ading obli\u00adga\u00adti\u00adons towards Stif\u00adtung ear under Sec\u00adtion 27 amen\u00added Elek\u00adtroG. Sec\u00adtion 28 amen\u00added Elek\u00adtroG now empha\u00adsi\u00ads\u00ades that the obli\u00adga\u00adti\u00adon to pro\u00advi\u00adde infor\u00adma\u00adti\u00adon with regard to reu\u00adse or tre\u00adat\u00adment must be pro\u00advi\u00added in Ger\u00adman or Eng\u00adlish, while the obli\u00adga\u00adti\u00adon to noti\u00adfy Stif\u00adtung ear of coll\u00adec\u00adtion points pur\u00adsu\u00adant to Artic\u00adle 25 (2) Elek\u00adtroG has been dele\u00adted. <\/li>\n<\/ul>\n

          Elec\u00adtro\u00adnic mar\u00adket\u00adplaces and ful\u00adfilm\u00adent ser\u00advice pro\u00advi\u00adders:<\/h4>\n
            \n
          • The amend\u00adment intro\u00addu\u00adces the terms \u201celec\u00adtro\u00adnic mar\u00adket\u00adplace\u201d, \u201cope\u00adra\u00adtor of an elec\u00adtro\u00adnic mar\u00adket\u00adplace\u201d and \u201cful\u00adfilm\u00adent ser\u00advice pro\u00advi\u00adder\u201d.<\/li>\n
          • Sin\u00adce 1 Janu\u00adary 2023, \u201cope\u00adra\u00adtors of an elec\u00adtro\u00adnic mar\u00adket\u00adplace\u201d and \u201cful\u00adfilm\u00adent ser\u00advice pro\u00advi\u00adders\u201d have only been allo\u00adwed to offer or per\u00adform their ser\u00advices for manu\u00adfac\u00adtu\u00adr\u00aders who have duly regis\u00adtered under the Elek\u00adtroG.<\/li>\n
          • Any vio\u00adla\u00adti\u00adons con\u00adsti\u00adtu\u00adte a regu\u00adla\u00adto\u00adry offence.<\/li>\n<\/ul>\n

            Chan\u00adges con\u00adcer\u00adning regis\u00adtra\u00adti\u00adon:<\/h4>\n
              \n
            • An addi\u00adti\u00adon has been made to the infor\u00adma\u00adti\u00adon in Annex 2, which is to be pro\u00advi\u00added upon regis\u00adtra\u00adti\u00adon.<\/li>\n
            • It now says: \u201cin the case of dis\u00adtri\u00adbu\u00adti\u00adon by means of distance com\u00admu\u00adni\u00adca\u00adti\u00adon to other EU Mem\u00adber Sta\u00adtes: List of Mem\u00adber Sta\u00adtes and name of the aut\u00adho\u00adri\u00adsed repre\u00adsen\u00adta\u00adti\u00adve in the Mem\u00adber Sta\u00adtes whe\u00adre the pro\u00addu\u00adcer dis\u00adtri\u00adbu\u00adtes elec\u00adtri\u00adcal and elec\u00adtro\u00adnic equip\u00adment by means of distance com\u00admu\u00adni\u00adca\u00adti\u00adon\u201d.<\/li>\n<\/ul>\n

              Take-back by the dis\u00adtri\u00adbu\u00adtor:<\/h4>\n
                \n
              • Sin\u00adce 1 July 2022, the take-back obli\u00adga\u00adti\u00adons of major dis\u00adtri\u00adbu\u00adtors also app\u00adly to food retail\u00aders with a sales area of 800 squa\u00adre met\u00adres or more, pro\u00advi\u00added they offer elec\u00adtri\u00adcal or elec\u00adtro\u00adnic equip\u00adment seve\u00adral times a year, or on a regu\u00adlar basis. <\/li>\n
              • In addi\u00adti\u00adon, Sec\u00adtion 17 amen\u00added Elek\u00adtroG pro\u00advi\u00addes even more expli\u00adcit\u00adly that free take-back must also be offe\u00adred in the case of free deli\u00advery to pri\u00adva\u00adte house\u00adholds. Under the amen\u00added law, dis\u00adtri\u00adbu\u00adtors are now obli\u00adged to express\u00adly ask cus\u00adto\u00admers sig\u00adning a sales con\u00adtract whe\u00adther they wish any was\u00adte equip\u00adment to be coll\u00adec\u00adted when the new equip\u00adment is deli\u00adver\u00aded. This also appli\u00ades to inter\u00adnet retail\u00aders when sel\u00adling three of the six appli\u00adance cate\u00adgo\u00adries (i.e. the rather lar\u00adger, bul\u00adkier ones). <\/li>\n
              • Fur\u00adther\u00admo\u00adre, the infor\u00adma\u00adti\u00adon obli\u00adga\u00adti\u00adon is exten\u00added and con\u00adcre\u00adti\u00adsed by Sec\u00adtion 18 para. 3 amen\u00added Elek\u00adtroG (among others \u201cwithin the cus\u00adto\u00admers\u2019 line of visi\u00adon\u201d). The breach of this infor\u00adma\u00adti\u00adon obli\u00adga\u00adti\u00adon has also been added to the list of regu\u00adla\u00adto\u00adry offen\u00adces. <\/li>\n
              • The obli\u00adga\u00adti\u00adon of dis\u00adtri\u00adbu\u00adtors to indi\u00adca\u00adte exis\u00adting coll\u00adec\u00adtion points in Sec\u00adtion 23 para. 3 Elek\u00adtroG has been dele\u00adted, as has Sec\u00adtion 29 para. 4 Elek\u00adtroG, which con\u00adcerns the obli\u00adga\u00adti\u00adon of dis\u00adtri\u00adbu\u00adtors to inform Stif\u00adtung ear in case they hand over taken-back WEEE to manu\u00adfac\u00adtu\u00adr\u00aders, their aut\u00adho\u00adri\u00adsed repre\u00adsen\u00adta\u00adti\u00adves or public dis\u00adpo\u00adsal pro\u00advi\u00adders. <\/li>\n<\/ul>\n
