However, as it sets different dates for individual rules within the Regulation, these will come into effect at different times. An important date \u2013   <\/span><strong><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">18 August 2025<\/span><\/strong><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\"> \u2013 is approaching, on which various stipulations will become mandatory. Our overview outlines the key changes for producers, importers and distributors, and explains where action is required. <\/span> <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b69323 elementor-widget elementor-widget-text-editor\" data-id=\"2b69323\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h3>BattVO defines new battery categories<\/h3><p><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">The revised battery classification is a key element of the Battery Regulation. The number of battery types has been increased from three to five, adding   <\/span><strong><span lang=\"DE-DE\" data-contrast=\"auto\">electric vehicle batteries<\/span><\/strong> <span lang=\"DE-DE\" data-contrast=\"auto\">and<\/span><span lang=\"DE-DE\" data-contrast=\"auto\"> <strong>light means of transport batteries<\/strong><\/span>, e.g. <strong><span lang=\"DE-DE\" data-contrast=\"auto\">LMT batteries<\/span><\/strong>.  <\/p><ul><li>The category name for portable batteries will remain unchanged. <\/li><li><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">Instead of industrial batteries, there are now three battery categories.<\/span> <\/li><li><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">Automotive batteries will be renamed starting, lighting and ignition batteries (SLI batteries).<\/span> <\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8d3157f elementor-widget elementor-widget-image\" data-id=\"8d3157f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"800\" height=\"455\" src=\"https:\/\/www.noventiz.de\/wp-content\/uploads\/graphic-EU-Battery-Regulation-1024x582.png\" class=\"attachment-large size-large wp-image-18122\" alt=\"Graphic showing new battery categories in the BattVO\" srcset=\"https:\/\/www.noventiz.de\/wp-content\/uploads\/graphic-EU-Battery-Regulation-1024x582.png 1024w, https:\/\/www.noventiz.de\/wp-content\/uploads\/graphic-EU-Battery-Regulation-300x170.png 300w, https:\/\/www.noventiz.de\/wp-content\/uploads\/graphic-EU-Battery-Regulation-768x436.png 768w, https:\/\/www.noventiz.de\/wp-content\/uploads\/graphic-EU-Battery-Regulation.png 1100w\" sizes=\"(max-width: 800px) 100vw, 800px\">\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-26b66f6 elementor-widget elementor-widget-text-editor\" data-id=\"26b66f6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">This change means that all producers will need to take action. In the stiftung ear\u2019s portal, producers must update their registrations to ensure they comply with the latest stipulations. Anyone who fails to do so within the specified time period (18 August 2025 to 15 January 2026) risks having their existing registrations waived.  <\/span> <\/p><h3>All battery categories are subject to mandatory participation <\/h3><p>Under the new Battery Regulation, Extended Producer Responsibility includes the obligation to join a producer responsibility organisation (PRO). A PRO must be designated for each battery category and recorded in the <a href=\"https:\/\/www.stiftung-ear.de\/\" target=\"_blank\" rel=\"noopener\">stiftung ear\u2019s portal.<\/a>  <\/p><h3>stiftung ear\u2019s portal: Additional reporting obligations <\/h3><p>As well as transferring previously reported battery types into the new battery categories and designating a PRO, manufacturers must also provide information on the chemistry of their batteries in the stiftung ear\u2019s portal. In addition, supplying a VAT identification number is now mandatory.  <\/p><h3>Authorised representatives required for producers based abroad <\/h3><p>According to the Battery Regulation, producers whose registered company office is located outside of Germany will be required, from 18 August 2025 onwards, to appoint an authorised representative if they place batteries on the German market. This authorised representative will take on all of the producer\u2019s obligations, including completing registration in the stiftung ear\u2019s portal.  <\/p><p>We are happy to offer this service to our clients. A valid registration is mandatory for placing batteries on the German market.  <\/span> <\/p>\n\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div> \n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20333e0 elementor-widget elementor-widget-text-editor\" data-id=\"20333e0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h3>Companies based abroad <\/h3><p><span lang=\"DE-DE\" xml:lang=\"DE-DE\" data-contrast=\"auto\">Once the revised Battery Regulation has come into force, companies whose registered office is located abroad, but who nevertheless place batteries on the German market, will be required to appoint an authorised representative. They may select and mandate an authorised representative between 1 April and 18 August 2025. The authorised representative must have completed the registration of the foreign company in the stiftung ear\u2019s portal by 18 August 2025, otherwise the company\u2019s entry in the portal will be deleted.
