What is the Conformity Assessment Procedure?
The conformity assessment procedure is a documented testing process that allows companies to prove that their packaging meets PPWR requirements. It is mandatory for every package placed on the market from August 12, 2026 – whether single-use or reusable packaging.
Objective:
To ensure compliance with requirements regarding substance restrictions, recyclability, labelling and other aspects.
Know the requirements:
Check which PPWR requirements apply to your packaging (in particular Articles 5 to 12).
Create technical documentation:
Comprehensible and traceable documentation must be created for each type of packaging. This documentation must include:
- Description of the packaging and its purpose
- Materials used
- Proof of compliance with legal requirements
- Inspections, tests, applied standards and methods
- Results and any corrective actions
Perform internal checks:
- Regularly check that your packaging meets the requirements.
- Document all checks, tests and changes.
- Keep the documentation up to date at all times.
Create a declaration of conformity:
Once the process is complete, a written declaration of conformity is created for each type of packaging. This officially confirms that your packaging complies with the PPWR requirements.
Storage & submission:
Documentation and the declaration of conformity must be stored:
- 5 years for single-use packaging
- 10 years for reusable packaging
The documents must be available for inspection by the authorities.

The Packaging Act (VerpackG) currently still applies in Germany. Even though the new EU Packaging and Packaging Waste Regulation (PPWR) has direct effect in Germany, national law must still be adapted. For this purpose, the Packaging Implementation Act (VerpackDG) has been presented as a draft.
The comment period for this draft ended on December 5, 2025. Until then, dual systems and other stakeholders, such as associations, could submit their comments. After the deadline, evaluation and final legislation begin.
Important: The current draft of the VerpackDG is not yet final, and even after it comes into force, companies must continue to expect further adjustments to German packaging legislation in the future. This means that additional new requirements and obligations may be introduced – even if they are not currently included in the law or draft.
