EU Battery Regulation: New obligations for producers
Revised Battery Regulation
The new European Battery Regulation (BattVO) came into force on 18 February 2024. However, as it sets different dates for individual rules within the Regulation, these will come into effect at different times. An important date – 18 August 2025 – is approaching, on which various stipulations will become mandatory. Our overview outlines the key changes for producers, importers and distributors, and explains where action is required.
BattVO defines new battery categories
The revised battery classification is a key element of the Battery Regulation. The number of battery types has been increased from three to five, adding electric vehicle batteries and light means of transport batteries, e.g. LMT batteries.
- The category name for portable batteries will remain unchanged.
- Instead of industrial batteries, there are now three battery categories.
- Automotive batteries will be renamed starting, lighting and ignition batteries (SLI batteries).
This change means that all producers will need to take action. In the stiftung ear’s portal, producers must update their registrations to ensure they comply with the latest stipulations. Anyone who fails to do so within the specified time period (18 August 2025 to 15 January 2026) risks having their existing registrations waived.
All battery categories are subject to mandatory participation
Under the new Battery Regulation, Extended Producer Responsibility includes the obligation to join a producer responsibility organisation (PRO). A PRO must be designated for each battery category and recorded in the stiftung ear’s portal.
stiftung ear’s portal: Additional reporting obligations
As well as transferring previously reported battery types into the new battery categories and designating a PRO, manufacturers must also provide information on the chemistry of their batteries in the stiftung ear’s portal. In addition, supplying a VAT identification number is now mandatory.
Authorised representatives required for producers based abroad
According to the Battery Regulation, producers whose registered company office is located outside of Germany will be required, from 18 August 2025 onwards, to appoint an authorised representative if they place batteries on the German market. This authorised representative will take on all of the producer’s obligations, including completing registration in the stiftung ear’s portal.

New EU Battery Regulation What do producers need to do now?
Companies based in Germany
For companies with a registered office in Germany, 18 August 2025 until 15 January 2026 will be a transitional period during which they must update their registrations in the stiftung ear’s portal. The following steps must be completed:
- Select the correct battery categories in line with the new classification.
- Designate a producer responsibility organisation (PRO) for each battery category.
- Provide information on the chemistry of the batteries.
- Enter your tax identification number.
Please note:
After 15 January 2026, any registrations that haven’t been updated will no longer comply with the stipulations of the European Battery Regulation and will be deleted from 16 January 2026. A valid registration is mandatory for placing batteries on the German market.
Companies based abroad
Once the revised Battery Regulation has come into force, companies whose registered office is located abroad, but who nevertheless place batteries on the German market, will be required to appoint an authorised representative. They may select and mandate an authorised representative between 1 April and 18 August 2025. The authorised representative must have completed the registration of the foreign company in the stiftung ear’s portal by 18 August 2025, otherwise the company’s entry in the portal will be deleted. After 18 August 2025, registrations can only be carried out by an authorised representative.
