PPWR declaration of conformity: What companies need to know
The PPWR countdown has begun – from 12 August 2026, a declaration of conformity will be required for all packaging.
What is the PPWR declaration of conformity?
The declaration of conformity under Section 39 of the PPWR is a written self-declaration by manufacturers, confirming that their packaging meets all the requirements of the new EU Packaging Regulation. From 12 August 2026, it will be mandatory for every type of packaging.
Who issues the declaration of conformity?
Any manufacturers who places packaging on the market is required to issue a declaration of conformity – regardless of the type of packaging. The obligation applies to every piece of packaging from the effective date with no transitional period.
What elements must be included in a declaration of conformity?
- Clear elements allowing identification of the packaging (e.g., type, batch or serial number)
- Manufacturer’s contact details
- Description and identification of the packaging allowing traceability
- The following sentence: This declaration of conformity is issued under the sole responsibility of the manufacturer.
- Declaration confirming compliance with all relevant PPWR rules
- etc.
Does the declaration of conformity need to be submitted?
No, it does not need to be submitted, but it must be made available at any time upon request (e.g. by authorities) along with the technical documentation. Retention periods: 5 years (single-use), 10 years (reusable).
What is the difference between a declaration of conformity and a conformity assessment?
- A conformity assessment is a technical testing process to demonstrate that a packaging meets the PPWR requirements (e.g., recyclability, labelling, traceability).
- The declaration of conformity is issued once the assessment procedure has been completed, and officially confirms conformity.
Who is responsible for the declaration of conformity of own brands?
The manufacturer’s obligations must be met by the client who distributes the product under their own brand. The producer must provide all required packaging information.
