The PPWR count­down has begun – from 12 August 2026, a decla­ra­ti­on of con­for­mi­ty will be requi­red for all pack­a­ging.

What is the PPWR decla­ra­ti­on of con­for­mi­ty?

The decla­ra­ti­on of con­for­mi­ty under Sec­tion 39 of the PPWR is a writ­ten self-decla­ra­ti­on by manu­fac­tu­r­ers, con­fir­ming that their pack­a­ging meets all the requi­re­ments of the new EU Pack­a­ging Regu­la­ti­on. From 12 August 2026, it will be man­da­to­ry for every type of pack­a­ging.

What ele­ments must be included in a decla­ra­ti­on of con­for­mi­ty?

Does the decla­ra­ti­on of con­for­mi­ty need to be sub­mit­ted?

No, it does not need to be sub­mit­ted, but it must be made available at any time upon request (e.g. by aut­ho­ri­ties) along with the tech­ni­cal docu­men­ta­ti­on. Reten­ti­on peri­ods: 5 years (sin­gle-use), 10 years (reusable).

What is the dif­fe­rence bet­ween a decla­ra­ti­on of con­for­mi­ty and a con­for­mi­ty assess­ment?

  • A con­for­mi­ty assess­ment is a tech­ni­cal test­ing pro­cess to demons­tra­te that a pack­a­ging meets the PPWR requi­re­ments (e.g., recy­cla­bi­li­ty, label­ling, tracea­bi­li­ty).
  • The decla­ra­ti­on of con­for­mi­ty is issued once the assess­ment pro­ce­du­re has been com­ple­ted, and offi­ci­al­ly con­firms con­for­mi­ty.

Who is respon­si­ble for the decla­ra­ti­on of con­for­mi­ty of own brands?

The manufacturer’s obli­ga­ti­ons must be met by the cli­ent who dis­tri­bu­tes the pro­duct under their own brand. The pro­du­cer must pro­vi­de all requi­red pack­a­ging infor­ma­ti­on.
