Legal requirements for commercial on-site waste management
The Commercial Waste Ordinance (GewAbfV) defines the requirements for on-site waste disposal in companies. With the current version, which came into force on 1 August 2017 and has since been amended several times, the legal requirements have been tightened once again and the legislator has extended the requirements for producers and owners of commercial waste, Sections 3 (1) and (3), 4a GewAbfV. Among other things, recyclable waste must be collected separately in order to create waste fractions that are as pure as possible. This is a prerequisite for efficient recycling and thus helps to reduce the volume of residual waste. For companies, this means increased costs for separate collection, recycling and documentation. Existing waste disposal concepts must be revised, and questions and uncertainties arise regarding the implementation of the legal requirements. Often, the legal requirements are not known in detail, and companies risk fines.

These requirements include reliability, special expertise of both the owner and the employees, appropriate technical equipment and the mandatory documentation of all waste management activities. A certified company may perform various activities, each of which is subject to strict regulations and must be individually reviewed and certified. These activities include the collection, transportation, storage, treatment, recovery, trading and brokering of waste.

In June 2017, the revised version of the Waste Management Officer Ordinance (AbfBeauftrV) came into force. It defines in detail which companies require a waste management officer. These include, for example, landfills, hospitals and clinics, but also manufacturers and distributors who take back a certain volume of sales packaging or transport packaging each year.
